Terms and Conditions

This is a translation provided for convenience. In the event of any discrepancy, the Spanish version of these Terms and Conditions shall prevail.

1. Scope and acceptance

These Terms and Conditions (hereinafter, the “Conditions”) govern the contracting of the services offered through the website sevitonina.es, owned by Kindergarden Jardilin S.L. (hereinafter, “Sevitonina”), whose identifying details are:

Making a booking through the website implies full and unconditional acceptance of these Conditions, as well as of the Legal Notice and the Privacy Policy. We recommend that you read these documents carefully before booking.

2. Description of the service

Sevitonina offers cultural and wellbeing experiences that combine flamenco with principles of neuroscience, under its own methodology. The services include, among others:

  • Group experiences of wellbeing and cultural knowledge (Essence).
  • Experiences for corporate and educational groups and associations (Groups).
  • Exclusive, tailor-made experiences (Private Collection).
  • Collaborations with hotels, companies and institutions (Partners).

The specific characteristics of each experience (content, duration, location, number of participants and particular requirements) are set out in the descriptive page for each service published on the website.

3. Booking process and confirmation

3.1. Making a booking

Bookings are made through the booking system integrated into the website (Amelia), accessible from the Bookings section. The booking process consists of the following steps:

  • Selection of the experience and of an available date and time.
  • Indication of the number of participants.
  • Completion of the required contact details.
  • Acceptance of these Conditions.
  • Confirmation and, where applicable, payment.

3.2. Booking confirmation

Once the booking process is complete, the user will receive a confirmation with the details of the experience booked. The contract shall be deemed to be concluded at the moment the user receives that confirmation.

Sevitonina reserves the right not to confirm a booking if places are sold out, if there is a manifest error in the published price, or if it cannot verify the information provided by the user.

4. Prices and taxes

  • All prices published on the website are expressed in euros (€) and include the applicable VAT under current Spanish law.
  • The total price of the experience shall be the one indicated at the time the booking is confirmed.
  • Sevitonina reserves the right to change prices at any time. However, price changes will not affect bookings already confirmed.
  • In the case of tailor-made experiences (Private Collection, Groups), the price will be agreed individually and communicated to the client before confirmation.

5. Payment methods

Payment for the experiences may be made through the payment methods enabled in the booking system. Sevitonina may require full or partial payment at the time of booking, depending on the type of experience. Payment details will be indicated during the booking process.

6. Cancellation and refund policy

6.1. Cancellation by the user

The user may cancel their booking under the following conditions:

  • Cancellation more than 48 hours before the scheduled date and time of the experience: refund of 100% of the amount paid.
  • Cancellation between 24 and 48 hours before: refund of 50% of the amount paid.
  • Cancellation less than 24 hours before or failure to attend (no-show): no refund will be made.

Cancellation requests must be sent through our contact form. The date and time the request is received will determine the applicable notice period.

Refunds will be processed using the same payment method as the original booking and will be made within a maximum of 14 calendar days from confirmation of the cancellation.

6.2. Change of date

Subject to availability, the user may request a change of date at no additional cost if they give at least 48 hours’ notice. Changes requested with less than 48 hours’ notice are subject to availability and may incur additional costs.

7. Changes and cancellations by Sevitonina

7.1. Changes

Sevitonina reserves the right to make changes to the times, locations or content of the experiences where necessary for organisational, safety or force majeure reasons. In such cases, the user will be notified as far in advance as possible and reasonable alternatives will be offered.

7.2. Cancellation for reasons beyond our control

Sevitonina may cancel an experience due to force majeure, adverse weather conditions, the indisposition of the professional in charge, an insufficient number of participants or other exceptional circumstances beyond its control. If Sevitonina cancels, the user shall be entitled to:

  • Reschedule the experience for another available date at no additional cost.
  • Obtain a refund of 100% of the amount paid.

Cancellation by Sevitonina shall not give rise to any additional compensation, except in the cases provided for by current legislation.

8. User obligations

The user undertakes to:

  • Provide truthful, accurate and up-to-date information during the booking process.
  • Arrive punctually at the place and time indicated for the experience.
  • Follow the instructions of Sevitonina staff during the experience.
  • Behave respectfully towards staff, other participants and the premises.
  • Inform us in advance of any medical condition, allergy, physical limitation or other relevant circumstance that may affect their participation in the experience.
  • Not record, photograph or share content from the experiences without the express authorisation of Sevitonina.

Sevitonina reserves the right to refuse or interrupt the participation of any user whose behaviour is inappropriate, puts the safety of participants at risk or disrupts the normal running of the experience, with no right to a refund.

9. Limitation of liability

Sevitonina delivers its experiences with the utmost professionalism and care for participants. Nevertheless:

  • Sevitonina accepts no liability for damage arising from inaccurate information provided by the user, including the omission of relevant medical conditions.
  • Sevitonina shall not be liable for the loss, theft of or damage to participants’ personal belongings during the experiences.
  • Sevitonina’s liability shall in all cases be limited to the amount actually paid by the user for the experience booked, except in cases of damage caused by wilful misconduct or gross negligence.
  • Sevitonina’s experiences are cultural and general wellbeing experiences. They do not constitute or replace medical, therapeutic or psychological treatment of any kind.

10. Intellectual property

The Sevitonina methodology, the content of the experiences, the materials given to participants, the recordings, photographs and any other creative material used during the experiences are the exclusive property of Kindergarden Jardilin S.L. and are protected by applicable intellectual and industrial property law.

The reproduction, distribution, public communication or transformation of such content without the express written authorisation of Sevitonina is prohibited.

11. Data protection

The personal data provided during the booking process will be processed in accordance with our Privacy Policy, which you should consult for detailed information on the purposes of processing, legal bases, recipients, retention periods and the rights of data subjects.

12. Right of withdrawal

In accordance with article 103(l) of Spanish Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, the right of withdrawal does not apply to contracts for the provision of leisure services where the contract provides for a specific date or period of performance. However, the user may cancel their booking in accordance with the cancellation policy set out in section 6 of these Conditions.

13. Applicable law

These Conditions are governed by and construed in accordance with current Spanish law, including, among other rules:

  • Royal Legislative Decree 1/2007 of 16 November (consolidated text of the General Law for the Defence of Consumers and Users).
  • Act 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE).
  • Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR).

14. Jurisdiction

For the resolution of any dispute arising from these Conditions or from the contracting of Sevitonina’s services, both parties submit to the Courts and Tribunals of the city of Seville, unless consumer protection legislation establishes a different mandatory jurisdiction.

15. Alternative dispute resolution

In accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013, we inform you that the European Commission provides consumers with an online dispute resolution platform (the ODR platform), available at the following link:

This platform allows consumers and traders in the European Union to settle out of court any disputes arising from sales or service contracts concluded online.

16. Severability

If any clause of these Conditions is declared null, invalid or unenforceable by a competent court, such invalidity shall not affect the validity and enforceability of the remaining clauses, which shall remain in full force and effect. The clause declared null shall be replaced by another which, being valid, fulfils as far as possible the purpose intended by the original clause.

17. Amendments to these Terms and Conditions

Sevitonina reserves the right to amend these Conditions at any time in order to adapt them to legislative, operational or commercial changes. Amendments will be published on this page indicating the date of the last update. Bookings already confirmed will be governed by the Conditions in force at the time of their confirmation.
